The verdict is in for Keith Dunford. The Regina man was found guilty of dangerous operation of a motor vehicle causing death in Weyburn Court of Queen's Bench Tuesday. Dunford, 47, faced the charge after a 2012 accident that killed flag person Ashley Richards near Midale.

Dunford was acquitted of the second charge stemming from the accident. Justice Lana Krogan found him not guilty of criminal negligence causing death. In her decision, Justice Krogan said the Crown did not prove beyond a reasonable doubt that Dunford showed wanton and reckless disregard for the lives and safety of others. However, he was travelling between 90 and 100 kilometres per hour at the time of the accident, exceeding the posted 60/km per hour speed limit. Also, he passed two semis just before the accident occurred, hence being guilty of dangerous driving.

Defense lawyer Aaron Fox said the case was never a dispute of the facts, but an interpretation of the law.

"I'm obviously disappointed. Pleased that she found that there wasn't criminal negligence here, which I thought was a stretch to begin with." said Fox.

Crown Prosecutor Mitchell Miller said the verdict emphasizes the responsibility that everyone bears when driving through a work zone.

"It shows the great vigilance that is required of all of us in the orange zone and I think that's what this case greatly illustrates is the tragedy that can occur when we're not paying attention in the orange zone and it's a danger to workers and we all have that responsibility." said Miller.

The attorneys would not comment on what their expectations were for Dunford's sentence, however Fox indicated that jail time was expected. Sentencing submissions will be made in Weyburn court on October 30. Dunford could face up to 14 years in jail.
